If someone got shoplifted but not reported to police by the security, however he must sign the form that retail stores usally have.

  1. They do have the right to search you. And Security Officers/Loss Prevention Officers are not off duty police. They are security guards.


  2. I'm no expert, but probably. Many are off-duty police officers.

  3. Guys please. 4th amendment(illegal search and seizure) does not apply to private citizens, just representatives of the state/govt(cops). Most will only do a quick frisk of the person for concealed items and weapons and leave the search up to the police but is not illegal if they do. Some departments have a SILA(summons in liew of arrest) program that allows certified security depts to issue citations for specific crimes with verified ID, no ID have to wait for an officer to arrive. Don't break the law, not near as embarrassing.  

  4. Yes, unfortunately for you. You are on their property and they have a right to search you and your belongings, this includes your wallet. The reason is to see if you have had another offense in the same store. That "form" you signed usually contains an agreement that you will not come on their property for a defined period of time {IE a year) and if you do you are trespassing. They hold all the keys as to if you are turned over to the police or not.
