Question:

Does a server have to pay for the meal if someone walks out in Florida?

I had a table walk out today, and I had to pay for their food which is horrible especially after the tip share is taken out as well. I was just wondering if in Florida restaurants are allowed to make the waitress pay for the meal, or is there a law like in other states where they can't make you do that. I have been trying to find the answer and haven't come up with anything. A link would be great. Thank you so much!!

  1. I don't know of any link. However generally speaking, the restaurants  in Michigan the wait staff has to pay if a walk out/or they are short.


  2. Technically, no. The restaurant can't force you to pay. However, you can (and will) lose your job if you don't pay for it. Don't forget, you are an "employee-at-will" and can be dismissed from your job at any time (unless you have a a contract, or are represented by a a union).

    It is typical for wait staff to pay for "walk-outs", even if it is not the fault of the wait staff.

    Don't expect to continue in the business if you fight it-it's just the way it is. Yeah, it s*cks-but it's in the nature of the business.
