In this case, there is no written language in the agreement that says that the tenant is liable for legal fees.

  1. Often, the loser of a civil suit has to pay the legal fees of the winner.

  2. If the tenant is being taken to court for non-payment of rent or some other breech of contract, yes they will be responsible for all court cost.

  3. As a general rule, tenant is responsible for collection costs and/or legal fees that are related to a breach of lease.  This includes thing ranging from non-payment of rent to property damage.

It depends on the judge, they are usually requested in every law suit.    The judge usually awards them to the winner, whoever that is, when the case is a waste of time, it was obvious who would win in the first place.   If the loser could conceivably have honestly believed they were in the right the judge often makes each party pay their own.
