Does a union contract supersede state law in California?

As far as getting paid overtime. As well as all other state employment laws, and does the jones act apply if you work out on the water

  1. Where is the ship registered, or where is the company based?   I worked with people getting less than Hawai'i  minimum wage while in Hawai'i.   They were getting the Florida minimum wage because thats where the companies headquarters were.   Same would probably be true for OT.    The jones act was designed specifically for those working on the water, so probably yes.


  2. I don't know how california works, but in New York you get what's in the contract. If OT isn't written in, you don't get it. Usually the contracts have to follow certain basic guidelines. You should talk to your union rep if you have any questions.  The Jones act does apply to Merchant Sailors, which you are, if you work on a tug.

  3. State law is generated by the people of the state, through their representatives.  Unions don't have more power than the population of the state.

    The Jones Act deals mainly with injuries while working on the water.
