  1. if they apply for residency and are approved and have been married more than 2 years then yes. If any of the above do not happen then no.


  2. No, of course not.  The marriage changes nothing.  The only way to get the illegal's status changed requires the illegal to leave and go home.  Once the illegal is back where he/she belongs you can start the process.

  3. No, the US citizen must file a petition for the spouse to get the US Resident Card (green card). This is only approved by a US Consular officer after they have reviewed your case. If approved, then you are allowed to work in the US.

Since you are already here and already married "with" a US citizen, (should be married to) than go to the USCIS and adjust your status.  It is illegal to enter the US with the intentions of adjusting your status, but since you already have than go down and make it legal.  You won't be tossed, take your marriage licenses and your husband with you.  It will cost something, but it will still be cheaper than had you done it the right way. Once you have status than you can work.

  6. No, the illegal alien must return to their own country and have the spouse petition for them to come here legally.  That is the only way.

  7. No.  Marriage to an American changes nothing.

  8. You can apply for an Employment Authorization Card. The only way it will be approved is if your spouse has filed a petition for you to become a lawful permanent resident, and you have applied for adjustment of status.
