My fiance has a child who he might be a father to in Florida. The ex girlfriend never told him what hospital or any details about the child. He has seen only one picture and that was 6 mos. ago. We have no proof that this child even exist, example a birth certificate or even the name of the hospital. But of course now she wants money. She doesnt even have a job, because she is using it as leverage to get more child support because she thinks my fiance will have to pay 100% of her bills.

How does one find an attorney in another state>? How do we know the attorney is any good? And my question that I really have Is can the ex girlfriend go after my income as a source of income for her>? I am a nurse and work 2 jobs to have the lifestyle that I want. I just am so sad about all of this. I love my boyfriend. But I dont think it would be fair for me to have to pay for this child. I need to know because if this is true I dont think I will be able to marry the one I love.

  1. First child support is only between the father and mother of the child so yours is not included whatsoever in figuring child support. Also your bf needs to challenge her on this, like pay for the paternity test to make 100 % sure. Now mom will only get the state mandated child support amount and nothing for her support. You can contact a family law attorney near you for directions on how to proceed her, first meeting is usually free of charge. He is not responsible for her bills so dont worry there. Dont sign or agree to anything from her or her attorney until you have whatever checked out by an attorney first as the courts cant undo anything done outside the courtroom. Your income also cant be included even if you two get married, and also trust your gut instinct when selecting a lawyer. You wont need the most expensive one here as this is only civil and not criminal so let her pay for the attorney to prove her case

  2. The first thing they'll do is a paternity test to make sure he is the father of the child. They can't take money from him if he isn't.

The Florida guidelines must take into consideration all income and earnings of both parents and the children's health care needs. They cannot and will not include your income in the equation.
