That isn't how it works.  First, you can't cast the spell unless you're a practitioner of magic.  The mermaid spell, though, does not make you turn into one when you're wet.  You'll have control over it.  You can hide your tail anytime you need to.  You don't get any powers, but you get improved vision and hearing and the ability to feel movement around you.
