Does anybody know,how I can cash a two-party IRS stimulus payment ?

The check is half of my injured spouse claim....I filed because my husband owes child support. We don't have a bank account and he is out of town for the next 2 weeks...I have to pay off my rent...and bills...what can I do?

  1. On the legal line (pay to the order of :________) does it have "Jane AND/OR Joe?" or does it say "Jane AND Joe?" I put emphasis on this because legally if the check says "AND" you will have to cash the check with your husband.  If there is "OR" than you can cash/deposit the check into your account.  

    Other than that do you know anyone that works for a bank/credit union? Usually if they know you are an honest customer they MAY make an exception.  Generally speaking this is NOT legal, but some people bend the rules (or law in this case)

I'm assuming you filed as an injured spouse to not have your refund intercepted by the IRS for back child support?  Best way to do it is just sign his name sloppy and then sign your name when you get to the bank and ask to cash it.  It will look like he signed it before you.  Legally speaking the bank should cash the check; however, if the check was for a large amount and you didn't bank there they may not cash it without him present.  It's worth a try anyways!  

  4. you may be able to cash the check if you have current power of attorney to handle financial affairs for your spouse.
