Does anybody know about probating wills in new jersey?

my father in law died 4 years ago and left his will to a neighbor thru treachery ibelieve.however she has not probated this will and doesnt want any part of it.what can we do to get the estate back in our name.my mother in law is already deceased.and my husband is the only child

  1. If your father is the only child and the will was never probated, then he needs to contact an attorney and file an estate. He is legally entitled to everything unless your grandfather put it in writing that he wanted otherwise. If the neighbor has something against probating the will, then filing it is the best thing you can do. The neighbor can't stop your dad from doing it. If the will is a coerced one, then the court will see through it. If the neighbor "wants no part of it", then legally nothing is left to her and she has no claim to it until the Probate court gives it to her. So call her bluff.


  2. I don't have your answer and sorry for you loss I hope you do follow through.  I believe everthing should be left to family.  I'm there for you and your husband.
