  1. Hi! They are not going to be specfic about this because everyone is different. I am not sure what kind of work/case load they have currently and that can effect it too.

    I applied for a i-130 for my husband and I believe that all i-130's are for immediate relation (husband, wife, son/daughter, or adopted child). SO that gives you a priority above others but still interviews have to be set up and paperwork can be delaying especially if you have to get medical records, police reports, and other complicated stuff.

    If you have all relevant and required doc's in perfect order (all original, notarized, signed and stamped, legally valid doc's), then the visa and permanent residency card will be issued within at least one year. It could be longer however if some doc's are missing or questionable or of course if an investigation finds an applicant to be lying. In our case it was delayed because a divorce certificate was foreign and confusing to translate and unfamiliar to the embassy, so it took a few months longer to clear it through the foreign courts.

    My best advice is to be present with your family member at each interview. It helps speed things up and also be sure to bring EVERYTHING with you along with copies of originals. Call weekly to inquire about the status and bug them. It will keep you informed of the case and if they refuse to disclose the information, then go in person. You are more likely to get answers face to face and they are often vague over the phone.

    Keep copies of all tax returns, check stubbs, personal letters, e-mails (you can fix your e-mail settings to save all SENT messages and saving them can save your behind in some instances), and keep copies of faxes/letters sent to the embassy as they may ask for them later.  

    Be prepared to be questioned and thoroughly investigated. Sometimes they tap into phones, internet, and check you through employers or various family members or close friends. But don't let it scare you it is just their way of being sure that you are an honest person and that you have nothing to hide.

    Don't expect to get names of agents, they don't disclose who they are for security reasons. If a suspicious person approaches you at any time it is most likely an agent who is investigating you personally. Again don't be alarmed it is a routine thing and they usually just make small talk about where you are from as if you were strangers just passing everyday conversation but as long as you are honest then everything will be ok. I went through all of this with my husband and we would have never achieved this without a strong understanding. It is so important to stick together with your spouse/family member no matter what. Family pictures and lots of photo albums can really help too. Make as many as you can.

  2. The processing time depends on the priority.  

    If you're petitioning a brother, Priority 4, the wait for a visa is 12 to 22 years so the processing time might be 8 or 10 years since there's no hurry.
