Question:

Does anybody knows if having a B1/B2 visa would be rejected because I have 5 months of pregnancy?

I came to the US on February this year to see my boyfriend, got pregnant and now my visa expires on August this year. We already sent the application to extend my visa for 6 months with the medical certification that I am pregnant; however, I don't know anything about immigration laws.

My big fear right now is the fact that if I have to fly back to my country then I expose my baby to anything through the trip.

  1. It should be; we have more "anchors" here than you'd see in our whole naval fleet. Have the baby in your own country.

  2. Having one US citizen parent is enough to cause the baby to be a US citizen itself. However expect immigration to at least look very closely at your request to extend your stay. That isn't saying the automatically deny it, just look at it a bit harder

  3. it safe for you to fly up to 8 months pregnant in a normal pregnancy ~ most airlines do not allow you to fly past 28 weeks.!!!

Do you got any plan to go back home after you have your child in the U.S (I'm not buying your fear of flying due to pregnancy)

Eligibility Requirements: Anyone currently in the United States on a B-1 or B-2 visa may file for an extension of stay. However there are no guarantees that the application will be approved. The USCIS takes into consideration factors that show your intention of departing the United States at the end of the proposed extension period. The applicant must submit the extension of stay application before the current authorized stay expires. The applicant is also required to provide proper evidence of financial support.

  4. How long will your flight be if you decide to leave before your baby is born? Which country is it?

I think its unsafe to fly if you're 5 months pregnant. However, If you have medical certification from a medical doctor, then hopefully immigration officials will understand your case.

Whether or not your visitor visa will be rejected is ultimately up to the discretion of the customs officer handling your case. I hope everything works out in your favour and that of your unborn child.

Edit: To the oh-so-brilliant people with your "smart" loser thumbs. How safe would it be for her to fly home while pregnant? So you really want her to fly just because you think she is trying to have an "anchor baby". aren't you concerned for her safety and that of her unborn child? Wow, people really are cruel and disgusting. This is a true definite sign the world is ending.

  5. It is safer for you to fly back now rather than to wait until after the child is born.

  6. If you are having a normal pregnancy then you can fly home in August.  I flew when I was 7 months pregnant with my son.  Let me tell you, it was much more enjoyable than flying with a newborn!!

As to whether or not your visa is in jeopardy, it just depends.  If immigration is suspicious, and they will be as most people on a visit visa don't get pregnant, then might suspect you of trying to have a child for the purpose of citizenship.  I'm not saying this is true but you have to understand that this is what they encounter everyday.

Why can't you go home and have the baby in familiar surroundings and your boyfriend can travel to be there for the birth.

  7. Shooting for the anchor baby huh?

Well they need to crack down on that stuff.

  8. Perhaps...if immigration thinks you want to  have your child in the US for citizenship purposes.  It's safe to fly now.  It's less safe for the baby to fly while an infant THEN he/she can be exposed to an awful lot.

If you are truly concerned, you should consider flying home now and not returning until after the first 6 months when your child has built up immunities and gotten vaccinations.
