Question:

Does anyone know, if I would be responsible for paying for an automobile accident if....?

My husband and I are parting ways. He has not paid for his insurance on the car my mom gave him as a gift, for four months. I have been paying it myself, although my name is not on the car, and I do not drive. I told him to keep it, through the divorce, (which he has yet to file)...but if I hadn't paid the insurance, it wouldn't have gotten paid. They told me at the office, that if it is cancelled, and he gets into an accident, that they could get a judgement against me, and make me pay too, if it happens while we are married.. So I have been paying it for him, also don't want to see him not have medical, if he gets into an accident etc. Is this true? would I have to pay? (especially if he say for instance, lost his job and I am working and he isn't ....?) I am worried sick over this. I don't know why he isn't paying it. I just don't know.He loved that truck.

  1. You're talking about two difference insurance policies here. I'm neither an insurance professional nor a lawyer, but for what it's worth...

    One kind of insurance is automotive, for the car your mom bought him. It covers injuries and death of the other driver(s) and any passenger(s), property damage, etc. It *may* cover his car, too, but not necessarily.

    If he's in an accident and there's a legal judgment against him (he gets sued and loses), and you were still married at the time of the accident, you are both liable for that judgment. Ouch. (Makes you want a quickie divorce, huh?) Of course, if the insurance is paid up and it's enough to cover the judgment, the insurance policy pays the judgment, so you're wise to continue paying on it.

    Your auto insurance doesn't pay for his medical bills in the event of an accident, though. Is he covered by your health insurance policy, or is he uninsured?

    When you separate and start divorce proceedings, this is one thing your lawyers need to work out. No reason you should continue paying his coverage for one moment longer than is necessary.


  2. If your name isn't on the title of the truck you can call the insurance company and remove your name from the policy. You need to speak to your divorce lawyer first (if you don't have one you need to reatin one ASAP). There are dozens of ways to get yourself out of this legally so for heaven's sake do it!

    You don't mention who the car is titled and registered to.  If you are still married, you will both get sued.

  4. who's name is on the insurance? If you are not named on the insurance than don't worry. I would also check with your lawyer and see what he/she has to say

  5. Due to the fact your still married, unfortunately the answer is 'yes' they could involve you in a suit.  

    I would speak with a divorce lawyer on how to go about it.  You need to have it in writing that your no longer together or responsible for items that are rewarded to him in the settlement.
