Does anyone know how many feet from the railroad tracks is considered railroad property?

I live on property that is beside a railroad track. I need to know how much of my back yard is mine.

  1. Railroad land is property.  You figure out property lines the same way as with any other kind of property.

    There's no magic number of so many feet from the tracks.  I've worked for a railroad whose property tended to be 80 feet wide, but our track wasn't always centered on it!

    Along railroad property, you will often find a fence line, or archaelogical evidence of a former fence line.  That's not necessarily the property line, but it's a good rough guess.  If you're spending money, get a proper survey.

    You can also approach the railroad's real-estate department about buying, leasing, or getting an easement on a section of their property that you might care about using in some way.  It's not a big risk for the railroad; they can take any property they want by eminent domain.


  2. Indeed, property lengths vary but somewhere around 20-25 feet is usually the average.  To know specifically in your case simply check your local courthouse land deed records and it should tell you where the railroad's property ends away from the tracks.

  3. None!!!! Any person, corporation, business, church, etc..... That beleives they own any part of this world is a complete idiot in denial. Yep, ther isn't a court in the world that would agree but all the same it's a fact.   4. RIGHT OF WAY CHANGE FROM LOCATION TO LOCATION. Check you tax map to is if if show the way of way or if you see a track inspector going down the track, stop and ask him.

  5. as i recall the right of way is 25 ft on either side of the tracks.
