My son is a 10th grader. He has been tested and has a learning disability and add. public school was not following the 504 plan at all. They were passing my son through the system. I went to the office before he started ninth grade and told them that in middleschool he would shut down if he didn't understand the subject. They assured me that this would not happen. I went to conferences to find out he had 27 missing assignments and not one letter or phone call letting me know this. We put him in a private school for different learners and for the first time in 10 years my son made the honor roll. We had hardship and I do not want to put him back in public school to be left behind again. I'll take any help you have to offer.

  1. First off, I would request a new evaluation in writing and hope that he qualifies for an IEP this time instead of a 504.  IEPs are much stricter regarding implementation.  504s are not really designed to provide individualized education as it sounds like your son needs.  504s are accommodation plans - like longer testing times, no penalty for excessive absences due to a medical condition, etc.

  2. Now this depends on where you live. But there are organizations such as one in New York called Advocates for Children. They are pro bono lawyers that work to form a case for you... the case must prove that the public school that your child is in is not the best spot. Once that is proven, the state is REQUIRED to pay for the proper education. I would look at this site for more information http://www.advocatesforchildren.org/... just to get an idea.
