Does anyone know if I legally need to pay my landlord again?

My landlord never cashed my cashier's check that I've now paid to him twice and it automatically gets returned to my account after 90 days. He's lazy and messy so he probably lost them. I have legal documentation on my accounts that I've paid him (now twice) What can he legally do if I don't pay him for the third time?

  1. you're in a sticky spot.  you technically have to pay him, ever if he lost the checks.  your lease requires you to pay for every month of occupancy.  

    my advice is simple - move out.

You don't have to pay him (for those months)  If you have copies of receipts, and have paid him twice, then you are not responsible if he is to lazy or irresponsible to cash them.  I am not sure if you are talking about paying him again for the same month or paying him for the next month's rent.  If it is the next month's rent, then you have to pay him.  I would take the other person's advice and move out.  He will probably bombard you at once wanting all his money, and you may get in a tough situation.

  3. It's his own fault...he cannot press any charges against you for his un-organized ways. If you have proof that you paid him twice don't sweat it...

  4. if it got returned to ur account that means u got the money back, so u should be happy that he keeps on messing up and u get the money back.

    just pay him, if the check gets returned to ur account again then b happy.

  5. I'd say nothing.  You as soon as you have given him the check it is his money whether he chooses to cash it or not you cannot control but you held up your end of the deal.

  6. Morally you owe him the money. You agreed to pay for a place to live.

  7. Legally. You have tried to pay him, you have documentation, and solid proof that you have tried to pay him. of course, the judge willl ask why u never tried cash, but hey, i think u have a good case at least if the landlord decides be be an @$$ =]
