Can an employer change the time you punch in and out? If so, are there any requirements to changing the times?

  1. well im no legal expert, but it seems to me that since you are working during those 10 minutes you should be paid for it. first go to the payroll or HR dept and state that you are working during that time. but in oregon anyway you dont have to be paid to put on your uniform so only suggest that they give you an extra 5 minutes per day. it's all i can help with, but then again im no expert


  2. i'm not sure but that is a good question. where i work if i punch in at 8:23 instead of 8:30 i do not get paid anymore or any less but if i punch out at 4:23 instead of 4:30 they can dock me 15 mins.

  3. no they have to pay you for that 10 minutes you work but it does depend on what state you live in if your emplyeer is doing this then dont punch in till 6 and if they question you about it tell them you dont work for free and if they require this of you then they have to pay you for the 10 minutes you worked

  4. Depends on State law, and you didn't tell us where you are.

    If what you did between 5:50 and 6:00 was "at the direction of your employer" then it's paid time.

    Federal law is the least restrictive, and several states have stricter rules, so the law where you are 'may' be more restrictive than this.....

    Your boss can require you to punch in already in uniform, UNLESS he prohibits you from taking your uniforms home and requires you to change a work, or if the nature of your work makes that "unreasonable". (If you work inside the sewers you're not expected to take the bus home still covered in you-know-what)

    If your boss requires you to clock in in building A, but report for work at 6:00am in building B then your time from clocking in until you get to B is on the clock.

  5. If you want to play hardball, just tell them that if they are going to pay you starting at 6 am only that you will clock in at 6 am only.

    I had the exact same problem at my work.  I noticed I was missing some time and my boss admitted that he took like 12 min. off my time to "round it off".  So I asked to see a policy on when exactly time is rounded off so I could make sure that I only work when I am on the clock and then he threw a fit and called me childish and that it's all give and take and clock is rounding up and down etc. etc.

    As I see it, the clock always rounds up for the company and down for me and so does the boss.  The 12 min. he took off were already rounded down by the clock so since then, I clock in at 7 and leave at 3:30 and that's it.  Next time they start whining about overtime, I will ask for that policy again :)

    I am sure though that there are still some places using those old clocks that only click every 15 min. and with those, you can lose up to half hour a day if you are not careful when you clock in and out.
