when you seperate or divorce your spouse is entitled to your BAH?

  1. No but ask a JAG officer for some advice. They (JAG) can't do your divorce so you need a civilian attorney. Shop around a find one that suits you. Don't get bully into hiring a "Larry the Lawyer"


  2. Divorce you get nothing.  The soldier would most likely be living back in the barracks unless there are children involved or he is at least the rank of E-5.

    Seperated not sure I think a portion of it.  

    It will depend on the courts with whom gets custody etc.  Best bet would be to hire a lawyer if you can't be on friendly terms.

    The child would still have health care etc. and be able to use on post facilities.

  3. I THINK the spouse may be 'entitled' to money for child support purposes.  But, not just the spouse alone.  And, I want to say that you may have to help take care of the spouse if he/she presses the issue.  But, that may be on a case by case basis.  It also depends on the state.  If you are pending a divorce, you may be responsible for her living until the divorce is final.

  4. once your divorced no your spouse will not get bah

    the person who has the child will get child support, but not bah, and it will depend on his income and what state it is as to how much - a judge will more than likely decide unless you guys can do it alone...
