Question:

Does anyone know the laws in Missouri when a home seller fails to disclose problems in the home?

We were in the process of buying a home in Missouri that the realtor was certain would pass an inspection and was livable. The disclosure did not mention any major problems in the home so we were of the belief that this home would pass an inspection. After doing an inspection on the home, the home inspector said the home was "uninhabitable" so there went all our hard work trying to buy this home "down the drain." On the bright side, our contract stated that the earnest money we paid would be returned if the home failed to pass an inspection. We're still angry about this though because the time we spent trying to buy this home (several months of trying to find financing, signing all the paperwork, etc.), we could have spent trying to find a home that would pass an inspection. What we'd like to know is, can we sue the owner of the home for failing to disclose major problems in the home to reimburse us for the loss of our valuable time & money spent trying to buy this home?

  1. hate to tell you this, you are not entitled to my knowledge for what would be called punitive damages. look on the bright side, good thing the inspector found these problems, or you would be stuck with a bad house, scratch it up as a learning process and find a better one.. good luck
