Haas made full restitution to the IRS and is currently serving a 24 month sentence in federal prison. His projected release date is October 6, 2009.

During his imprisonment, Haas was ordered to relinquish his NASCAR team to Margaret Haas and team general manager Joe Custer. Tony Stewart purchased equity interest in the team in July 2008.

The team receives engine and technical support from Hendrick Motorsports. It was announced on July 10th, 2008 that Tony Stewart, two-time Sprint Cup Series champion, will buy 50% of the team and the team will be renamed Stewart Haas Racing. Stewart would also become one of the two drivers for the team as well. The team is currently owned by Margaret Haas and also by team general manager Joe Custer while Gene Haas serves prison time for tax evasion.

Haas is to HMS as Yates is to Roush/Fenway.  Don't be fooled by the name of the race team, it is basically owned by Rick Hendrick.  He is only allowed to own 4 teams, according to the rules NASCAR has placed on owners, but just like Jack found a loophole in the system so did Rick.  Rick has been out of jail for a long time, or did he avoid going all together?  It was so long ago I can't remember anymore.  He DID get pardoned eventually and his slate wiped clean, much like an anullment in the Catholic churches LOL  Have a good one!
