  1. In 2003, Chiras sued the board in federal court, alleging it had violated his rights under the First and Fourteenth amendments by discriminating against his views. He is represented by the Trial Lawyers for Public Justice.

    “The reality is, in the past and through the present, the state board of education has shown a tendency to reject texts that they don’t agree with, or another influential body doesn’t agree with,” said Steven Jensen, one of Chiras’ lawyers. “If they can restrict speech just because they disagree with it, the First Amendment has no meaning.”

    The court, however, dismissed Chiras’ lawsuit, concluding that the Board of Education had legitimate pedagogical, or teaching, reasons for engaging in viewpoint discrimination. Chiras and his lawyers have taken the case to the Fifth Circuit Court of Appeals in Louisiana.

    It was then not selected for review by the Supreme Court.
