Does being parked in the wrong direction negate liability by a 2nd party if the 2nd party backs into the car?

My daughter was parked in a legal street parking spot in front of our home. The neighbor backed out and hit her car. The catch is, she was parked in the wrong direction. Is the neighbor responsible for repairing the damage or does being parked illegally negate his liability?

  1. It does not matter if she was parked the wrong way.

    Chances are he would have hit her car if it were parked the right way too.

    Regardless, he hit a parked vehicle. He is 100% at fault.  


  2. well really wouldnt have mattered which way she was park if she was to the side of road like she shoul dhave been and got hit by someone backing up she would have got hit either way right car was just turn a differnt direction.... so it wouldnt have done any good to park the other way she would have still got run over right but then your to park going with the flow of  not against

  3. Doesn't matter if she was parked the wrong way or parked in a no parking zone. The neighbor should have been looking at where the heck he was going. He is responsible.
