Does he pay child support retroactively from birth?

My child's father did not want to have a child and he is not on her birth certificate, nor does not want to pay child support through the court. As her mother, this is okay with me because I would prefer him having no connection with my child. I would rather struggle than have my daughter placed in a potentially harmful situation. However, the child's father has seen my daughter and acknowledges she is his daughter but has not offered a penny of support and wants to see her occasionally; I am not allowing this. Later, if he decides to be a part of my daughter's life and he pursues his legal rights, will be have to pay child support retroactively from the child's birth? I have proof that he accepts that she is his daughter.

  1. No, child support will not be retroactive.  It's incumbent upon the two of you to either work it out or for the custodial parent to file for support.  None of the time leading up to filing will be considered.

    If he chooses to invoke his parental rights or you decide to push for child support, a paternity test will have to be done to establish that he is the father.  Even if he acknowledges that he is the father, he will not be legally considered her father until the test is done unless you were married at the time the child was born.  Courts won't accept both of you acknowledging that he is the father.  They will require proof.

  3. Whether or not he accepts that she is his daughter the man still has no legal rights as a parent or an obligation to pay child support until you have a DNA test that proves he is the father. Point Blank.  Most judicial systems will require him to pay child support from the time that paternity is established.  If he wants to be part of this child's life then do the right thing and get everything legal.  Go to your local Child support office and file.  The judge will request a DNA test, then will order support based on BOTH your incomes.  If you really don't want the man in your child's life you do not have to let him see her since once again HE DOES NOT HAVE ANY RIGHTS TO YOUR DAUGHTER.  But I hope that you make the right decision.  Remember all little girls need their daddies  

  4. No, not from birth, from a number of years which the court will decide.  Your not asking for it for many years, WILL definitely be taken into account, AGAINST your case.

  5. No it only starts to add up from the time you file you have to file. Then if he doesn't pay from that time the order is passed he will always owe until he pays it all.
