Question:

Does homeowners insurance cover the injury of a person if caused by someone else?

A friend of mine was injured when he was horsing around with another person at someone's house. Now, the two people involved, the injured and the injuree (?) are not the homeowner. Can the injured person try to the get homeowners insurance to cover it? They can't lie their way about how the injury happened since they told the hospital it came from the two guys horsing around. My thinking is, it might have been covered IF the person slipped or fell and there was no involvement by anyone else but since it was these two guys messing around, why would the homeowner or his insurance, be liable if it is? My guess is, unless it was the homeowner that caused the injury, or was caused by a fault or accident in the home itself, these people have no chance of getting the insurance company to pay. Any thoughts?

  1. The only time homeowners would pay is if the injury is caused by a problem with the property or house...for example a crack in the sidewalk or broken stairs.  They can attempt to have the insurance pay, but it is doubtful that it is the fault of the property and they have a poor chance.


  2. Most homeowners policies have medical payments coverage available to anyone that accidentally gets hurt from no fault of the property owner....this is not same as liability coverage. If the person was horsing around and hurt himself on someone's property, he would have medical payments coverage afforded to him, which is generally $2,000-$5,000.

    Liability claims are a whole different story. If the guy was invited onto the property and(for instance) fell in a concealed hole in the yard and broke his leg, he would have the full amount of liability coverage available to him. BUT......the property owner has to be negligent in maintaining the property for liability to be assessed to him or her.

  3. Liability coverage would only come into the factor if your friend decided to take the homeowner due to negligence, this would fall under what is called the Non Auto Liability portion of your homeowners policy which helps protect the homeowner against lawsuits, but... good news for your friend is that homeowners policies often come with what is called medical coverage which covers incidents that occur in the home to non insured people or people that aren't listed on the homeowners insurance.  This coverage should take care of your friend since he was hurt on the property itself but isn't blaming the homeowner for him being hurt.  I hope this clears things up for you.

  5. Policy coverage varies by company and by selections decided on by the policy owner. Injury to a non-owner is generally a covered loss. The owner may have to pay the deductible portion.

    The owner should contact the company or refer to the policy.

  6. First of all, an outside party cannot directly file a claim against another's homeowner insurance.  They would have to sue the homeowner, whose insurance would then defend them.  From what you say, it doesn't appear that your two clowns have much of a case.
