Does it count as a rape?

When a wife don't want to have s*x with the husband. By the husband force his way to have s*x with her. After so many times resisting it the wife got no choice but to give it to him. Does that still count as rape? Is it illegal and can she sue him?

  1. Yes. A husband forcing s*x on his wife is raping her. She should file for divorce and file a lawsuit.

    It's 2008. Women are not property to be used as their husband sees fit.


  2. Yes if she says no and he forces her - it's rape plain and simple. She can do more than sue him...she can land him a nice cozy jail cell.

    Same thing if a wife were to rape her husband.

    Add: I smell a troll also. In your other questions you're a "man with a wife" then a "woman whose period came early".

  3. Absolutely.  If he forces her into s*x, it's rape, even if they are married and just had consensual s*x 20 minutes prior to the rape.  Defining it as rape is easy, but proving what happened to a jury is harder.

    If he just whines and bugs her when she's not in the mood until she gives in, it's not rape.  In that case, she had options, and giving in was the option she chose.  She could've left, made him sleep on the couch, gone to the spare room and locked the door, talked to him about how whining and bugging isn't s**y...any number of things.

    FFS, if someone doesn't want to have s3x with someone, or is too young or drunk or drug affected or mentally incapable to consent, in fact if someone isn't hot and panting at the thought of jumping in the sack with a person and they're tricked or forced or lured, even if it doesn't end in rape charges, the person is a CREEP.

    Have s3x with sober adults who want to do it too, and you'll cut these worries in helf!

  7. Yes it's rape and she can do a lot more than sue him.  If she wanted to, she can send him to jail.

    Just because you're married does not mean you can't be raped by your spouse.  Spousal rape is (now) very illegal.

Why is this even a question?  If two people are married this shouldn't even come up.  The man should respect her enough to know what to do to get her in the mood.  If she's having a bad day, he should ask about it, not try to bring up s*x.  On the reverse side, the woman should explain why she doesn't feel that this is the appropriate time for such, um, activities and put it off for another time.  But don't put it off too long, because that's part of what marriage is about.  Standing stiff and continually refusing to...er...give it up, is breaking a part of that contract.  Sounds cold, but it's true.  I mean, if you don't want to have s*x, why are you in the relationship?  Everybody has bad days, but s*x should be the ultimate expression of love, not wielded as a weapon to cow your significant other into submission.

    As far as him asking for s*x repeatedly till she caves, thats not rape in the slightest, morally objectionable and very pathetic, but its not rape, cuz she could obviously say no.

    Thats like saying i shouldn't be guilty of doing meth because the drug dealer asked me like 20 times to buy some.

  19. Marital rape has been illegal in the UK since 1992.  I don't know about other countries though.  Before 1992 it was all good, baby.

    Makes you wonder what the point of even having a wife is.  It's like owning a car and being told you can't drive it whenever you like.
