Does it matter where I file Child support?

Me and my babys father of 6 yrs aren't together anymore because he is a liar/cheater. Our son is 9 months old. We currently live in Dallas,Tx but I plan to move to Reno with my mother and start my life over. Does it matter where I file for child support?

  1. u can filed wherever you live...even if the father is somewhere else...its easiest in the jurisdiction where the father is, but it doesnt make much difference..just funish as much info as you can about him and where he lives...works..etc


  2. UCCJEA is about what state has the authority to hear a custody case, and it is based on the home state of the CHILD.  The key point is that baby has to have lived in a place for 6 months. Since NV will NOT be the home state for 6 months, you cannot file there, until that time has passed.  IF HE FILES ANYTHING HERE in Dallas, then it will make Texas the home state, and it will all be here.

    What does matter is if you were married or not, as to what he may file.

    This really walks a very tricky line, that you need to know the exact details of, and tred very carefully.  

  3. Yes it matters! The county in which you file and that the order is made will have the jurisdictional control (really the state). You need to get a visitation and custody order in place like yesterday. He could file and prevent the move.
