Does it really matter how much a person's bail is?

like if one person gets a higher bail then another for practically the same offense does it mean that person will stay in jail longer?

  1. Another way to answer this question is that bail is set to help insure a person does not flee from the jurisdiction and returns to court for trial.

    The amount of bail set would be different for each person depending entirely on whether the Judge feels there is any substantial risk of the person not returning later.

    The judging criteria that would be used is how old is the person, are they homeowners in the area that are considered stable and prior convictions.

    As far as the amount of time that they might be sentenced, if you look up each crime under the Revised Code for that state, you will see a range spread. As an example only, a felony 5 drug abuse can range from 6, 12 or 18 months in Ohio. The amount of time that would be rendered would be dependant on past occurrances ( primarily).

  2. No, because both can post a bond. Now as far as staying in jail longer, the only reason one might be in there longer than the other is if one can't the money as fast !  

  3. bail amount is only one issue of criminal court procedures..depends of the level of crime done..sentencing by laws is another matter of itself

  4. The severity of the crime is only part of what determines the amount of the bail.

    The I can fill in a few more of the blanks, but I'm sure to miss a few.  

    Does the accused have strong ties to the area?  Are they just passing through?  Bail would be lower for a person with strong ties to the community, higher for someone with no ties to the community.

    Criminal history ... longer criminal records means higher bail.

    Financial status:  A richer person might wind up with a higher bail amount ... due to the fact that the court might want the accused to have a significant financial stake in showing up for the trial.
