Does my boss have to pay me gas mileage?

I live in Georgia and work in a retail / medical assistant position. Well when i first started working I had an extra expence of driving about 90 miles a week with no compensation. Since however, gas prices have gone up and now i'm putting in about 210 miles a week. I asked my boss about getting paid for the mileage, he said "no" he is not going to pay me any mileage.

If I am driving for work, is he required to pay me or is it his choice?

  1. NO !!! you accepted the job knowing it was 90 miles away. It sounds like poor planning on your part.


  2. He's not required.  You should have gotten that as part of your deal when you started.

    Edit: If he didn't tell you when you were hired that you would have to drive anywhere, then the first time he asked you to, you should have said, sorry, not without getting paid.  Unfortunately, you've allowed it to happen and progress and you can't change terms now.

  3. He is not required to unless you were hired on with the understanding you would be compensated for it. Just because it's more expensive now doesn't mean he has to pay.

  4. No, he doesn't have to pay you but it IS a tax deduction if you drive your own car as part of your job.  Make sure you take advantage of that when it comes tax time.

  5. Your employer paying for your mileage would be considered compensation, as in a part of your pay. If you didn't negotiate for it when you were hired you won't get it.

  6. His choice.  Keep track of the mileage and you can probably take it as a tax deduction (if you itemize) under the category of 'unreimbursed work related expenses'.

  7. No, it's his choice.  Many employers who had been paying this (at their own discretion) have since stopped offering this benefit due to the increased gas prices.
