Does my ex have to wait until AFTER our divorce is final to take my daughter and I off his health insurance?

  2. It all depends on the insurance company and the way things have been spelled out in the divorce. My bf had to pay for insurance for his ex for the whole 4 years of their separation because he couldn't take her off until their divorce was finalized.

    Trust me, he would have taken her off sooner if he could have. I'm sure no one appreciates receiving statements showing that your ex went to the hospital to have another baby.  

  3. If it is a group plan he has to wait until the next open enrollment, or for a legal separation / divorce. Not withstanding court orders.

  4. I don't think that there is any rule that he can't unless it is specifically written into the decree.  

  5. no, but he can be required to carry your daughter , and possibly yourself, on his insurance (assuming it is also his daughter). though, thats a matter for the court.

  6. You need to look over your decree. He may have been ordered to keep the insurance up for your daughter. If this is so and if he has cancelled it, he could be held in contempt.

No.  There is no rule that any person must keep their spouse and children on his or her insurance even while married with no divorce on the horizon.  If you don't have any stipulations in your divorce settlement on this issue (either how long insurance will continue, whether he will continue to insure your daughter after the divorce is final, or what % of her medical expenses will be paid by him) then you should see your attorney immediately.
