my friend was fired for cursing in front of a donor at the job, ironically the person she was cursing at hit her intentionally and provoked her, i don't feel that this act should have gone unpunished -- but she is a black female that was fired and the lady that hit here was a white female, well the black female was fired and the white female was not reprimand. Ironically a month later the same white female was called into the office because a client (not a donor) with an account with us reported her for cursing at her while at work. Nothing happened to the white female, not even a write up. A donor is considered what a client or a business sends in to be tested wheres a client is the actual account holder and the business. This happened about 2months ago- so should the terminated friend file a case with the EEOC

  1. She can try, but with as many cases as EEOC handles, I doubt it will go anywhere.

  2. Your friend has what appears to be a valid complaint for the EEOC, since she is in a protected class and was treated differently than another employee under the disciplinary system.  In the disciplinary systems I have worked with physical assault is normally cause for immediate termination, so I am surprised that no action was taken to discipline or terminate the assailant.
