Does my son's father have rights to visitation?

Ok, I got pregnant and had our son and now we aren't together anymore. So does he actually have visitation rights to him? But before anyone asks yes his name is on the birth certificate. But then again nothing has went through the court system yet either.

  1. Of course he does, unless the courts rule otherwise!


  2. I don't know what the legal system is where you live. Also whether or not you married, whether or not he has expressed any interest in your son before now. The matter is a bit more complex from a legal point of view.

    Putting that aside, depending on the age of your son, I see no problem with visitation if your son wants it. If your son is too young to make this decision for himself - and if you feel a visit would be detrimental to your son - then you are perfectly right to not allow it.

    If your son's father wants to  make an issue of it he can apply to the Courts for these rights. Maybe he is just wanting to rattle your cage for whatever reason.
