  1. Yes, it is part of the court's consideration of the "minimum contacts" a business or business person has in the jurisdiction.


  2. No, In order to exercise jurisdiction over a non-resident, the non-resident must have such minimum contacts with the state so that the exercise of jurisdiction does not offend traditional notions of fair play and substantial justice.  A web site alone, is not a minimum contact since even if you are shipping things to that state, you are not doing business there.  People from that state are contacting you and doing business with you.
