Does the american embassy check if youve overstayed your stay before and how?

Ive overstayed my visa before in america. i grew up not knowing i have, but i figured it out when i grew up. once i knew, i moved back to japan and have been here for 2 years. i want to visit my freinds in california next summer for a week or two. i have a new passport that i made in japan. i was wondering if they will issue me a tourist visa? i was also wondering how they check and know youve overstayed a visa before. do they know by looking at your passport or putting my name through a computer. what is it that lets them know? theres a question on the visa application asking if youve overstayed a visit before in america. should i put no or yes? if i put yes, does that kill all chances of me getting a visa? and if i put no, what are the chacnes they will find out and what are the consequences? thanks for anyone that can help me out.

  1. my question to u is : how old were u !??? if u were under 18 then overstaying will not be held against u since u were a minor , however if u overstayed after becoming 18 1/2 years old then overstaying will be held against u and yes they will know unless they threw all to the trash or were not keeping any records back then , anyways when talking to them make sure not not lie about it , its never a good thing to lie to them . sooo if u are in that situation the time u would get banned if u overstayed would depend in the time u did overstay , if less than a year after becoming 18 1/2 then ur ban will be of 5 years , if u overstayed more than a year after the 18 1/2 then u would be banned up to ten years . anyways i hope u did not and best of luck to u .


  2. If you lie on any visa or immigration application form or documents, any visa/green card you have received is revoked and you will be permanently barred from re-entry for committing perjury, a major felony.  Do not lie.  Do not misrepresent anything.

    You overstayed.  Say so (they already know that anyway), explain your parents brought you illegally when you were very young, and once you learned that you were in the US illegally, you returned home, and now you want a short visit with old school chums, even though you have made a life you want to keep, have a job you want to keep in Japan.

    If they give you a short tourist visa (no guarantees here!), you must be absolutely certain to leave before your I-94 expires.  Otherwise you are subject to prison term and permanent bar to re-entry.
