Does the cop who pulled me over show up in court even if i am pleasing guilty and only want a mitigation case?

i only want to mitigate this ticket, which means i am pleading guilty and trying to come to an agreement. i am going to ask for a deferral but i am wondering if the cop who pulled me over is gonna be at the hearing

  1. I am only required to show up to give testimony when someone pleas not guilty.

    I do not show up for no contest or guilty pleas. I am compensated for going to court, it is not cost effective for me to show up if I'm not needed.


  2. By law the cop has to be there. If he is not there, they will dismiss the ticket.

  4. The officer will be called, but may not be able to attend.  If he does not attend, you might be able to get off depending upon the charge.  Really, without knowing what you've been charged with, we can't give you definitive advice.

  5. Officers do not have to show up to any court date.  It is a myth that the ticket will be immediately dismissed if they are not there.  The only time officers are even notified about a court date is if the defendant pleads not guilty.  If the officer does not make it to the court date then the defendant still has to make the judge decide against the written comments on the citation.
