  2. the european arrest warrant means they will be arrested and deported to uk

  4. i hope so if you cant do the time dont do the crime,

  5. Extradition between EU member states - European Arrest Warrant

Since 1 January 2004 a European Arrest Warrant (EAW) valid throughout the EU has replaced extradition procedures between EU member states. An European Arrest Warrant may be issued by a national judicial authority if the person whose return is sought is accused of an offence for which the maximum penalty is at least a year in prison or if he or she has been sentenced to a prison term of at least four months.

The European Arrest Warrant Act 2003 implements the procedures in Ireland. It applies to extradition between two EU countries and does not affect extradition to any other country.

The Irish legislation implements the EU framework decision of 13 June 2002 on the European Arrest Warrant. At the time that decision was adopted, Ireland made a statement to the effect that it would implement the decision for the purposes of bringing a person to trial or for the purpose of executing a custodial sentence or detention order. The idea is to ensure that a person may not be extradited from Ireland and kept in custody for investigation purposes. As a general rule, it is not legal to arrest a person in Ireland in order to investigate an offence, it is only legal to arrest them in order to charge them with an offence. This is not the case in a number of EU countries. This statement is reflected in the European Arrest Warrants Act 2003.

ie An extradition order will be executed if there are charged with an offence.  An extradition order may not be iniated on the basis of an investigation.

  6. It depends on the reason that he is wanted in the U.K. If it is a valid charge, and the warrant has been properly served then he would be returned to face charges.

  7. Not at all. If there is a European arrest warrant, he will be arrested in Ireland and deported.
