Does their insurance have to pay What ever it cost to fix my car.?

I have a 97 honda civic I got hit in the back by a 2004 f-150. the cost to fix my car is 3,500 does their insurance have to pay. also my car had a body kit and after market tail lights. do they have to pay for that or are they just going to pay for the original ones.

  1. I think you will find with that much damage the insurance company will total the car.

    Normally when damage exceeds 2/3rds the value of the car, they will total it and I would say that $3500 is pretty close to the mark.

    If that is the case, they will pay you the market value of the car.

    Also, if they do repair it, they will not put aftermarket tail lights back in it, they will only fit standard ones.

    They may replace the bodykit, if it is noted on your insurance policy.

    BTW, if the tail lights arent approved and certified, the insurance company may not pay out as illegal items were fitted to the car.

  4. OK, this is important.  The other insurance company has NO DUTY OF GOOD FAITH TO YOU.  If they agree to pay, they will pay the LESSER of cost to repair, or actual cash value.  Find your actual cash value at www.kbb.com.

    I'd guess with $3500 in repairs, your car will total out.   You DO have the right to keep the car, but they will subtract SALVAGE VALUE.

    That body kit and after market tail lights probably are not going to increase the value of the car, even if you paid extra for them.  They do NOT pay the retail value that the kit/lights cost you.

  5. They don't have to fix your car at any cost.  If the cost is too high, they can simply buy you another '97 Honda Civic.  

    They don't actually buy you a car, they look in the Kelley Blue Book for what that car should cost, and they give you that amount in cash.  You can then buy any car you like.

    As for aftermarket upgrades, that depends on your contract with the insurance company.  If it's something extraordinary, they may not be willing to cover it unless you added a "rider" to the policy to cover it.

  6. Yes, they have to pay to put it back in the condition it was in before the accident.  However,  If the repairs, near or exceed the fair market value of the car, they will "total" it and pay you fair market value.  Report the accident to YOUR insurance company and they can help and advise you.

  7. the insurance will estimate how much they have to pay to you to fix the car,usually they have their own shop,so if you want to fix the car by your self you can not just give the bill to them just like that,but they have to see and estimate the car.

    and if you not agree with the price that they give it to you let them to fix it,ask them where the shop that belong to them,and let them fix the car so its look like new again,if not just get a lawyer,they not gonna charge you if you lose.
