Domestic Battery charge in the state of NY?

My husband and I got into an argument last night. We got up in each others faces, yelling, and then he kept yelling at me saying "hit me, come on, hit me!" So out of reflex and not thinking clearly about my actions, I did slap and hit him across the face, and accidentally made his ear bleed. I called the police because we both were still very upset and at that particular time he wanted me to move out. I was scared and called the police out of instinct, just to have someone else involved to help us. Long story short, I'm being charged with Domestic Battery. My husband and I want to work on our marriage and he really does not want me to leave. I know a lot of times we may say things out of anger and we do not mean them. My husband does not want to press charges, but I understand that his word is no good now. I haven't received notice of a court date yet, but I was told I will. My husband is in the military and we live on base in New York. What is going to happen the day I have to appear before a judge in court? Is this considered a misdemeanor in the state of NY and how do I obtain info on that? What do you think my punishment will be at my court date? Also, is there any way we can get out of this or is it too late? This is my 1st offense. I have never got into trouble with the law before. Please help, I am so scared!

  1. Quit referring to anonymous strangers.  You need to talk to 1) a lawyer and 2) a marriage counselor.


  2. you need to seek legal advice..get into counseling for your marriage and when you go in front of the judge, explain to him what the two of you desire to do in working on your marriage. It is all up to the law and what the judge will do according to the law. Getting into anger management classes and counseling are two great steps in the right direction
