Domestic battery(1st offense, No criminal record)?

What are the chances of a domestic battery charge being lessened to court supervion or probation! Never been in trouble before and it was a first offense. I've also been thinking about arguing the charge in court. But if I decide not to, generally what king of consequences are there?

  1. Depends on the state..CA has a 30 day mandatory jail sentence, fine, community service,anger management and a court ordered restraining order.

    Other than that unless you can prove you were in fear of your life..you're pretty much screwed.

    Also a life long ban from owning or having any firearm in your possession or near you.

There are too many "what-ifs" to answer your question on Yahoo answers.  You don't mention your state or county, the actual charge, if weapons or injuries were involved, etc.  I would contact an attorney.  Many domestic charges these days can result in jail time because states are taking it so much more seriously.

  4. Well, if it's your first time, it's very likely you'll get probation and will have to undergo a mental evaluation plus pay the court fines. But it depends what did you do exactly? Is it in a family court or criminal court? If it's in the family court, it's very likely you'll get probation. Either way, I advise you to have a lawyer and choose one very carefully, so he doesn't make it worse for you. I don't recommend arguing the case on your own - the judge will not listen what you have to say. Well, he will listen, but may not hear you, if you know what I mean... Good luck!
