Question:

Dr.'s recommended by lawyer charge exhorbitant fees and reduce my settlement, what can I do?

I've called the attorney about this. The doctor I met with saw me for 5 minutes asked me to try to bend over and then scheduled an MRI with a separate agency. I went to that appt. The bill states $900.00 for the doctor consultation and $1000.00 to read the MRI report, I've called a few separate agencies to see what they charge including the doctor's office and they said that this particular doctor works directly with the lawyer's office and that the office would never charge so much for a visit. They said that he does this indirectly because he is working on a lien, meaning they will get pay later. I'm really injured and will eventually have to have surgery on my back but will use my insurance. These and other large sums are being deducted from my settlement. What if anything can I do about this?

  2. You can't do anything about the charges already incurred.  You CAN change doctors and go back to your regular doctor.

    The next thing that I would do would be to get all my facts together, make copies of all the bills, and file complaints with both the state Bar association and the state Board of Medical Examiners.  The lawyer sends you to a doctor who intentionally overcharges, never told you that you had a choice in medical professionals, and now expects you to pay the bill for the doctor he picked.  The complaints may not do any good; you may just get a form letter that says "thank you for your concern.  We will look into it."  On the other hand, when a doctor is charging you 9 times the rate of an office visit just to tell you that you need an MRI, there's something not right in his practice.

  3. Tell your lawyer you will get the medical care you need and that you will provide him with bills and reports needed for the lawsuit.  You don't have to use the doctors your lawyer sends you to.
