Question:

Driver hit me on the freeway, doesn't want to report to insurance?

Driving on the freeway a truck hit the side of my car because he couldnt stop fast enough, tried to swerve.. anyway.

He didnt want to use insurance because he didnt want his rate to go up. He was extremely nice. I kind of had to do what he wanted because my license was suspended due to non-payment of an insurance ticket which I cant pay until I get my taxes back this year. And I didnt want him to call CHP and lose my car.

Anyway, the dent is really small. I can live with it. He wants to pay cash. I got 3 quotes, the lowest being 1100.00 but I am having a baby in 6 weeks, and I could really use the money rather then the dent being fixed.

How can I propose to him an offer like that without sounding like I am being scandalous or anything?

  1. Hopefully he has someone who advises him not to trust you.  No offense - the idea is nice, but who is to say you won't take the money and go after him in a few months again saying he never paid you.  He isn't very intelligent if he makes this deal and doesn't at least request a notarized receipt from you also saying you will not try to collect further from him or his insurance company.

    By the way, you're license is suspended for not paying an insurance ticket?  Does that mean you also have no insurance?  And, you are pregnant?  You sound like you will raise your child to be a very responsible, contributing member of society.


  2. Show him the estimates you got. Ask him how he wants to pay for it.

    If he pays you without going thru insurance, make sure you write up a document that says he paid you X amount of dollars for damage from an accident on whatever date.

    Both of you should sign it and keep a copy

  3. He doesn't want you to call CHP because he has no license, no insurance, or both. Oh, you're in the same boat as he probably is. You shouldn't have even been driving in the first place.  

  4. Tell him to give you a grand and you won't turn it in. It's up to you if you use the money to fix the dent.

  7. Take a quote written on paper signed by the person who gave it to you and send it to the person who hit you. if he doesn't want to tell his insurance , he will probably pay.

  8. Its too late. You both are scandalous.
