Hi, I get my temporary license in a matter of weeks and I have a couple of questions.

If I get caught driving more then 1 passenger in the state of Virginia what are the consequences?

Do I need insurance to drive using my dad's car although he already has it?

  1. Insurance goes with cars, not drivers, so if your dad has added you to the policy, you are covered.

    If you're caught with more than 1 passenger, you could lose your license.

    Passenger Restrictions

    If you are under age 18, you may carry only one passenger under age 18 during the first year that you hold your driver's license. After you have held your license for one year, you may carry only three passengers under age 18 until you reach age 18. Learner's permit holders may not carry more than one passenger under age 18. Passenger restrictions do not apply to family members.

    Violations of either the curfew or passenger restrictions can result in the suspension of your driver's license.

  2. I'm not sure how exactly the details are in Virginia, but car insurance works pretty much the same wherever you live.

    When you get a provisionary license (temporary license) you're not supposed to drive anybody under the age of 21. If you were to be pulled over and had someone in the car with you, technically you're supposed to be given a heavy ticket the first time, after that, they'll just suspend your license till you are an adult. Virginia might allow you to have one passenger, but if you were to get caught with more than that, it really depends on what kind of a cop you get and how he wants to treat you.

    But unless you're doing something stupid, you shouldn't get pulled over to begin with. So as long as you're a good driver, there should be no real harm in shuttling another passenger, if y'all are gonna behave.

    Any car you drive has to be insured, whether its rented, owned or borrowed. If it is your dad's, you should be included on his/your parents premium in order to drive; and you need to show proof of being an insured driver before you can take your license test.
