Question:

Drugs and Related Arrests?

Someone I know was recently arrested on drug related charges. I didn't get all of the story, just that he was caught selling hard drugs that contained methamphetamines, and he was now facing a minimum of 5 years in prison. He said that the people who originally went to the police about him are pressing for a man slaughter charge, but no one died. He told me that getting caught with the drug, and trafficking it can get you a manslaughter charge.

Has any one ever heard of this happening before?

Oh, we live in Canada.

  1. yes in canada certain drugs  like extacy you can get charged with manslaughter even if it hasn' killed anyone. i guess it's because there are so many wierd chemicals in the drugs, so yes it can happen!!

  2. I live in TX., and the state won't go for manslaughter unless someone dies.  Attempted manslaughter, maybe.  That would mean the state would have to prove intent to kill.  Very difficult in a drug possession case, even with intent to deliver.  Having personally been though the system a couple of times I would suggest he heed the advice of his attorney, be it court appointed or free-world.  Either way, he is probably going to do some time.  Depending on whether this his first offense or has other felony convictions will play a major role in the amount of time he will do.  Right now, the state of Tx. is making you do 1/4 of your time in prison before you become eligible for parole in none aggravated cases.  This means if he gets sentenced to 5 yrs. he will do about 15-16 months in prison, minus the time he spends in county jail.  He must not act out while in the joint as it will hurt his chances for parole.  While I don't want to see anyone go to prison, it may be what he needs to realize that he needs to change his priorities.  Wish him luck for me, and God Bless y'all

  3. this is a hard one my wife does this kind of stuff for a living  it realy depends the state has so many days to formaly charge you if they dont it is dropped in this case he can plead not guilty  somtimes not a good thing  or there might be some kind of ple deal meaning he might have to snitch on somome else // that somelese being the guy he is getting his stuff from but it all sounds realy bad at first but the minimum 5 years is not always true remember they make deals . hope this helped

  4. I'm not sure about the laws in Canada but here in the USA they can not unless the drug was given to some one and they died and they can PROVE it was the drug it self that caused the person death I think that the one who wants to press charges of manslaughter is angry and wants revenge

  5. Sounds like you really don't have all the story.  Manslaughter and trafficking are separate charges and don't coincide as one.
