Dual Citizenship? America and India?

My parents were born in India, but live in the us, and now have dual citizenship of the us and india. I am 14 years old, and have dual citizenship as well. The law is that either you, your parents, or grandparents must have been born in india for you to be allowed to be a citizen of india. So does this mean that my grandchildren wouldn't be allowed to be dualcitizens?

  1. Hi You are a bit misinformed.

    India doesn't recognize dual citizenship, either you can have citizenship of India or some other country, not both at least from Indian Govt. point of view.

    What your parents probably have is a PIO card which is given to Persons of Indian Origin.

    The law about parents and grand parents also applies to PIO.

    There are ways to get even your grand children the PIO card.

    But first you must understand it's not dual citizenship, Indian govt was planning to recognize dual citizenship for few countries but that idea was dropped and PIO was introduced.

As far as I know, you cannot be a dual citizen of the US and India as India does not recognize dual citizenship.  If your parents are naturalized US citizens, then they have lost their Indian citizenship.  They can now, since January 2006, have Overseas Citizenship of India (OCI) which allows for life long travel to India etc, but does not allow them to have an Indian passport, work for the government etc.  A person holding OCI can get Indian citizenship after residing in India for five years, I think.

    You, therefore, are a US citizen and can become a OCI, but not an Indian citizen, and so can your children.  Your grandchildren will not be able to be either citizen or OCI.
