Dual Nationality - Very Complex Question. 10 points at stake.?

I was born in San Francisco, USA. I lived There for 4 years. I have a social Security Number, an Expired American Passport and a Contra-Costa Birth Certificate. Both my parents are British, i moved to the UK at the age of 4. I

I have an American Passport (expired) and a British one. (for those of you who are British, i have an E111 card).

So what Nationality am i. It satys im my British Pasport that Dual nationals are not protected my the UK embassy.

What nationality am i?

PLease Help!!

  1. If you were born in the US you have US citizenship until you renounce it.  So, unless the UK doesn't allow dual citizenship then you are both.  Depends on the agreement between the two countries and if you told both countries about your other citizenship.

    Being that you're from Cali I would look into the tax laws, my brother was a resident of Cali and was expected to pay taxes even while he was working 7 years in Italy, so he switched to Washington state residency before moving and he didn't have to pay those taxes.  If you're going to keep your US citizenship but live abroad, make sure you don't end up owing a bunch of taxes.

  2. Your British American (holding dual citizenship) unless you have officially renounced either citizenship.

    The notes state:

    British nationals who are also nationals of another country cannot be protected by Her Majesty's Representatives against the authorities of that country. If, under the law of that country, they are liable for any oblication (such as military service) the fact that they are a British nationals does not exempt them from it. A person having some birth connection with a Commonwealth country, or foreign country (eg by birth, by descent through either parent, by marriage or by residence) may be a national of that country in addition of being a British national. Acquisition of British nationality or citizenship by a foreigner does not necessarily cause the loss of nationality of origin.

    What your British passport notes mean is that when you are in the USA you cannot claim that you are British and request the assistance of the British embassy as your American citizenship will override this (if you were in another country such as Australia or France you could claim help/protection from either American or UK embassy).

    On the photo page of both passport it should say under "nationality" American in the US one and British Citizen in the UK one.
