i got into an accident (not my fault). The accident took place on New years eve, so i couldn't pay till January 2. My parents not knowing about this is making me go to autopac. If i went to autopac and give my statement and everything.. will they know that i was driving without a renewed licence? i know, totally dumb of me, but this world is pricey to a indebt student. So... is it possible to go to autopac without them knowing i was driving on a unrenewed licence?? (If this helps, I'm in Manitoba (Canada))

  1. Looking at the Autopac t's and c's it looks like you are in the soup

    Illegal Use of Driver’s Licence

"You may be fined and your driver’s licence suspended if you misuse a driver’s licence. Examples of misuse include, but are not necessarily limited to:using an outdated or otherwise invalid licence;"

You'll probably find it invalidates your insurance too.

  2. Okay, there is a little difference in Manitoba.  You will, no matter what, be nailed for lapsed driver licence.  But, if you are carrying the higher liability and lower deductible options, your insurance will cover you.  In Manitoba, there is a clause that says, with BASIC insurance, you have to be "qualified and authorized" to drive.  However, if you have extended coverages, you have to be "qualified OR authorized", which means, if your licence would have been renewed without a problem, you are considered qualified.

I am presuming it was not your own vehicle, but your parents', because a vehicle in your name would have lapsed the same time as your driver licence!

If it is your parents' car, they will have to know.  You cannot report the accident on a different date, especially if there is a police report, or if the other driver filed an Autopac claim.  Any time an accident is reported on a date after a late licence renewal, it automatically flags the report to the SIU.  Best be honest, you will find Autopac (and your parents), a lot more flexible and willing to make some kind of deal.  they are very active at investigating any claim that is not quite right.  I have been an Autopac broker for some years, and my brother-in-law is a claims adjuster for MPI as well, so I have a fair idea what I am talking about.  However, like every other broker, we are not allowed to actually process or influence the auto claims in any way, unless called as witnesses.   This is different from our home insurance, where we are actually allowed, and expected, to file and follow up on claims (unless your house is burning as you phone, in which case we direct you immediately to the emergency claims line).
