What are the penilties for first offense DUI? and how do you go about getting a restricted DL? does this require a hearing or appointment with the DMV after the 30 days? are there any other factors to be aware of?

  2. The penalties vary depending on the circumstance and other factors like prior driving/criminal history. I hate to break it to you, but having been born and raised in the Bay Area, Marin is known as being one of the more vicious counties when it comes to handing out moving violations, and that's just non-DUI related ones. It also doesn't help that your BAL was way over the limit and you have a pending ticket. I once went to a lecture on tickets for moving violations where this lawyer came in and talked to us, and personally warned us never to get a moving violation in Marin or there'd be almost no way to get out of it. That being said, either get a lawyer and use them to work through it, or just plead guilty and deal with the penalties if the charges are reasonable.
