Dui: my husband has a first time dui he says. and the ticket is 800 dollars. we don't have the money. court is

court is in 2 weeks the most we will have is 500 what is going to happen. the clerk won't tell us. she says it is up to the judge to give extensions and he may not. does anyone know?

  3. Sounds like you would have had the money if he didn't drink it all away...   Sorry but if he drinks and drives and then kills someone else by his own stupidity, money would not be the issue...  Sorry no sympathy!

  4. good luck, I've never heard of a DUI as cheap as $800.  They should do a payment plan.  tisk.

  5. It is up to the judge.  Usually a payment plan can be worked out.  If he has not been to court yet, there is no fine yet.  The $800 is an estimate of what the fine will be.  It is far cheaper than an attorney to fight the case.

  6. First time violation may be eligible for payments. The clerk is correct, this is the judges decision. The fine may not be that much either. Most fines are listed as to what the maximum is.

    Pay the $500 and go on a payment plan for the rest

    Judge could reduce the fine to $500 and give him community service

    Jail.../

  9. This DUI will end up costing a lot more than $800.00. Your insurance will likely triple as well. There are also all sorts of surcharges and fees attached to the fines as well, so often the base fine will increase. I know in Arizona, they tack on something like 80% in surcharges, so that $800 ticket will become almost $1500.

    However, the Court will establish a payment plan for your husband so that he will be able to pay off the fine over the course of 6 - 12 months. However, the convenience of paying over time will result in an additional "Time Payment Fee" which is usually about $20.

  10. the clerk CANT tell you because its up to the judge,not the clerk.The court may extend a payment plan to you,they may not,but if they do,you d**n well better pay,and pay on time,or your troubles are just beginning.When your husband goes to court,make sure he is dressed(not in jeans and a t shirt),clean shaven and most of all RESPECTFUL to the judge,when he enters his plea,show remorse,dont be a smartass etc.and the judge will most likely worjk with him seeing its his first.

    Next time you or he drinks,DONT freakin drive!!!you play,you pay,this time all that happened is a ticket,it could have ended in an accident,a death,god only knows.smarten up!

  11. They will let him pay it out probably.  It is not in their best interest to put him in jail.  That cost them money.

Try to pay as much as possible before your court date.  In my court, if the Judge sees that you are making an effort to pay it, he will give an extension.  Of course, every Judge is different.  But i would think he would be more likely to give you more time if he sees that you are at least trying to pay.  

  13. They may accept the $500 and possibly make payment plans. Another thing they may do is send him to jail to pay off the rest.

    Here in NH, my husband had a $500 fine. He could not pay for it. So, for $50 a day in jail, he spent 10 day in jail and it was considered time served.

    Each state is set up differently. Hopefully they will accept a payment plan. The clerk cannot tell you because it depends on the judge and prosecutor.

    (I forgot & Thunder2 below mentioned it...another possibility is to work it off with Commnunity Service)
