Question:

E2 dependent visa interview, any advice?

I just got married to an E2 visa holder, we both live in the US and my visa expires in 4 months, thus I am planning on changing my status to E2 dependant, my question is, Does he need to be present at the interview? other than the marriage certificate is there a need for more documents? lastly, Can i go to any consulate in Mexico or Canada OR do i need to go to a consulate in the country where He is from (Germany)

  1. Was an application filed already? Did you file it as a change of status? From what status? If you are in US lawfully, just wait for the approval notice. Normally, there should be no interview.

    However, if you wish to obtain an actual VISA in your passport, then you will need to depart the USA (since you are lawfully in US, that should not pose a problem), and go to apply for a Visa not to Mexico or Canada, but to your native country (where you are originally from). In this case, there is no need to file anything with USCIS in US.

    Evidence normally required is the marriage certificate, evidence of bona fide marriage, evid. that he entered the USA as E2 already, could be some other evidence in re to his investment/business. So for the Consulate, a copy of the marriage certificate alone is not going to be enough.

    This is in general how it all works.
