EAD Missing?

Hi,

I have my visa appointment in Mexico in the month of Feb '08. But I found that my EAD is somehow missing from my documents.

And I am already on my H1B status and my EAD expiration date is on Jan 01., 2008

Could anyone please let me know if I need to re-apply for the duplicate EAD card to attend my visa appointment. And how long would it take to receive the duplicate EAD card.

P.S : Is it advisable to attend the visa interview in Mexico or in my 'Home Country' without having the EAD card

Please let me know.

  1. are you trying to apply for h1b stamping? you don't need EAD to apply for h1b stamping at US Embassy aboard. EAD is not a required documents for any US visa and it does not help or improve your chance to get your passport stamped. the required documents for h1b stamping are ds156 and ds157 application forms, your passport, I94 record, copy of the I-129 petition and the original approved I-797 petition.

    according to US department of state, applicants for temporary work visas should generally apply at the American Embassy or Consulate with jurisdiction over their place of permanent residence. Although visa applicants may apply at any U.S. consular office abroad, it may be more difficult to qualify for the visa outside the country of permanent residence.

    you can renew your EAD at USCIS by filing form I-765. the filing fee is $340. the current  waiting time is about 90 days.
