Early termination of probation. Do I need to appear with my lawyer?

I had private attorney help me through my case when I was in jail. Recently, I became eligible for early termination of probation. I filed for this early termination without his help or knowledge. Now, the courts notified HIM of my hearing. Does that mean that I have to appear with HIM? Can I just have a public defender assist me?

  1. If he wants to charge you, try for a public defender or go pro per.  talk to the attorney.

No, you cannot just "have" a public defender assist you.  You request a public defender at the BEGINNING of a criminal case, not to mention that you have to qualify as being unable to afford a lawyer (by their standards, not yours).  The court does not know that he isn't your lawyer anymore, and sent notification by their records. HE does not know he isn't your lawyer anymore, since you didn't have the courtesy to tell him "hey, I can do this by myself".

    So, now that you have a hearing on the calendar.. time to pick up the phone and see if he is available.  Don't be surprised if he is "already scheduled" on something else, and cannot be there.   If you terminate your contract with him (or he decides to withdraw), you get to do it on your own.  

  4. The Courts notified your Attorney because he is, for all intents and purposes, your representitive. You don’t have to appear with him, though it might be to your benefit. I’ve always found those who are paid by you to be a tad bit more focused towards your hearing.

  5. Better approach thru Attorney.....who is wellknown abt the case n background.
