Question:

Ebay buyer problem making claim?

I recently sent a game normal first class a week later the buyer claims he hasn't received it and has now opened a dispute.

I suspect he has the game and pretending he doesn't have it to get the free game so I am not sure what to do or say because I have no proof of sending it.

  1. You should ALWAYS obtain proof of postage.

If you can't prove you've sent it then you've had it i'm afraid.

You could maybe contact the buyers local sort office to see if it is there but that's about it. Sorry.

EDIT............ another tip would be to always state in your description that you cannot and will not be held responsible for items lost by Royal Mail ( that would cover your @rse as well)

  2. Unfortunately there isn't much you can do, not everyone on ebay is honest so it's always best to cover yourself.

I know it's not much help but what I do is send cheap stuff via normal mail and ask for proof of posting, send expensive stuff recorded delivery.

  3. If the buyer paid with PayPal, there's nothing you can do - PayPal will refund the buyer and take the money from you..

To win any PayPal dispute, you need to be able to prove that the item as delivered, and you can only do that by using Recorded or Special Delivery, both of which provide 'online tracking'.

Even if you had a proof of postage, PayPal won't accept that as proof of delivery and would award the claim against you.  You can use a POP to claim from Royal Mail, but even with that, nowadays your buyer has to sign to confirm that they didn't receive the package.

If your buyer paid by some other means (eg cheque, postal order) and the dispute is through eBay, they only act as mediators now and can't force you to refund the buyer, so you could stand your ground on that one.

  4. sadly if they payed by paypal then your are ment to send it trackable for that reason...sorry buy he is going to shaft you...

  5. Let this be a lesson to you.

Get a certificate of poting next time - you are kind of stuffed without it I'm afraid

  6. Unfortunately things do sometimes get lost in the post. If you had proof of posting then you could take it up with the post office and get compensation from them, but as you don't have this you will have to give him a refund. Make sure that you learn from this and get proof of posting in future.

  7. This has happened to me as a seller & buyer. I thankfully had proof of postage from the post office.  Thats the problem with e.bay you need to be able to trust people, have a look at the buyers feedback if its good then maybe it has just been lost in the post as this seems to happen quite a lot. If a decision can't be made by the two parties ebay will make a decision. Dont worry because this has to happen lots of times before they take any action. You may justget a neg feed back

    good luck

  8. You may have to bite the bullet and refund him. Next time, make sure you get proof of posting as a minimum, that way it will be insured for a small amount (up to £28 I think but could be wrong) If it is of any value, send via special delivery. Also you can send via recorded post for about 70p extra. Doesnt insure for more but stops him saying he hasnt received it.

  9. just ignore his emails because if you sent it you not in the wrong
